20 June 1702 [Court of Chancery]
Def: Hugh Brady, other Heffernan, Timothy Fogherty, Anthony Irby and his wife Elizabeth, John Heaphy & Congreve
Pet: Hassard Powell Esq
Identified as John Heaphy, of Waterford (Jacobite Officer) and later of Limerick, and a case concerning the mismanagement of the estate of Hassard Powell by his guardian, and uncle, Nicholas Mounckton (Jacobite Officer). On discovering the issue, Hassard suspended Nicholas and put David Wilson (father of Ralph Wilson), from his mother's side as guardian. His mother's sister, Constance Mounckton was married to David Wilson, Alderman, and brother to Ralph Wilson (friendly with King James's officers) of Caherclonlish, Limerick (Ref: Crossle Genealogical Abstracts). However, David Wilson, also mismanaged, shifting the profits of the Powell estate to his own private use, in addition to leasing Hassard's profits through query abatement to different tenants, at a lower price, such as John Walsh and West Mitchelstown to John Williams, who exchanged the lease with John Heaphy. That case was dated 25 May 1700, however the current case dated 1702, may or may not be related.

BRADY - Hugh Brady is husband of Mary Powell, dau of Hassard Powell & Elizabeth Mounckton.
CONGREVE - Rev. John Congreve (1656-1710), son of John Congreve, Cork and husband of Rebecca Jones (d.1730), m.1709, who descendants, Ambrose, would establish the Congreve family of Waterford. There is a connection between Rebecca Jones Congreve, daughter of James Jones, Kilkenny, and sister to Ambrose Jones, Bishop, Cashel, Martha, Jane and Sarah Jones with the Powell family, through Rebecca's mother/sister, Jane Jones. Connection is from the marriage of Richard Powell and Jane Jones in 1681. Richard is likely the son of Giles Powell, and brother to Hassard Powell, that the above case is about.
POWELL - Hassard Powell, son of Giles Powell & Joanne Russel, was the husband of Elizabeth Mounckton, sister to Thomas and Nicholas Mounckton. Their son, Hassard Powell (mentioned above) is the one who applied to the Court of Chancery to have his uncle, Nicholas removed as guardian of his estate.

This is the same place for the origin of the Heaphy family, who also had a connection to Tottenham family and that there was an earlier Tottenham connection to Ireland before John and Barnabus Tottenham.
